Ada yang kata selepas pindaan 1993, kuasa Sultan melantik Setiausaha Kerajaan Negeri, Penasihat Undang-Undang dan Pegawai Kewangan Negeri dilucutkan? Saya pamirkan di sini Undang-undang Tubuh Kerajaan Negeri Pahang sebelum 1993 dan juga selepas 1993 mengenai perkara yang berkaitan. Saya hanya mahu menyatakan kedudukan di Pahang. Di negeri lain, saya tidak ada dokumen undang-undang tubuh sebelum 1993, tapi yang saya lihat, hasil dari pindaan 1993, Perkara 11 dalam Undang-undang Tubuh Pahang dengan Perkara 52 Undang-Undang Tubuh Negeri Selangor jadi seragam.
Sila perhatikan Perkara 11 mengenai Setiausaha Kerajaan.Sila perhatikan Perkara 12 - Penasihat Undang-Undang, Perkara 13 - Pegawai Kewangan Negeri dan Perkara 14 - Kuasa Raja Pemerintah melantik Pegawai-Pegawai APABILA TIDAK ADA Suruhanjaya Perkhidmatan.

Saya tidak nampak apa yang dikatakan atau dihujahkan bahawa kuasa Raja Pemerintah telah dikurangkan atau telah dilucutkan. Yang jelas, sejak dulu lagi Suruhanjaya Perkhidmatan itu telah ada wujud dan apa yang dikatakan sebagai "Suruhanjaya Perkhidmatan yang berkenaan" itu ialah Suruhanjaya Perkhidmatan Awam (SPA) bagi lantikan jawatan SUK dan Pegawai Kewangan Negeri dan Suruhanjaya Perkhidmatan Kehakiman dan Perundangan bagi Penasihat Undang-Undang.

Before 1993, the Selangor Constitution did indeed give powers to the State regarding the appointment of the State Secretary. The original wording of section 52, clause (1), gives an indication of the background of the so-called constitutional “conventions”. The original text reads as follows:
ReplyDelete“(1) His Highness shall on the recommendation of the appropriate Service Commission by instrument under His Sign Manual and the State Seal appoint a person holding whole time office in the public services to be the State Secretary, the State Legal Adviser and the State Financial Officer respectively:
Provided that before acting on the recommendations of the Service Commission His Highness shall consider the advice of the Mentri Besar and may once refer the recommendation back to the Commission in order that it may be reconsidered.”
All the powers of the State in this section have since been deleted, giving full powers of appointment to the “appropriate Service Commission”. In addition, the original wording of clause (6) of the same section explicitly gave discretionary powers to the Sultan:
“(6) In the event of there being no Service Commission having jurisdication in respect of any appointment of any officers mentioned in Clause (1) such appointment may be made by His Highness acting in His discretion.”
This clause has been entirely deleted.
Thank you Teck Wyn for the pre 1993 provision of the Selangir State Constitution. As I understand it, its the Constitutional Convention of the advise by the MB take was taken out in the post 1993 amendment. Nevertheless, that general provision of the advice by the MB is actually enshrined in article 55 of the Constituion.
